1. Acceptance of Terms

By accessing or using iamchampion.ai ("Champion," "the Service"), operated by Build It Code It Foundation, a 501(c)(3) nonprofit organization (EIN 82-4016299), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Champion is an AI-powered operations platform for restaurant owners. We provide customer experience reports, revenue analytics, menu optimization, daily briefings, and other business intelligence tools. Some features are free; others require a paid subscription.

3. Account Registration

To access certain features, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

4. Free and Paid Services

Free Tier: Customer Experience reports, review analysis, review alerts, and basic competitor comparisons are provided at no cost.
Paid Tier: Advanced features including POS analytics, menu engine, bookkeeping, daily briefings, and growth playbooks require a subscription at $199/month per location.
We reserve the right to modify pricing with 30 days' notice.

5. Billing and Cancellation

Subscriptions are billed monthly via Stripe.
You may cancel at any time from your dashboard. Cancellation takes effect at the end of the current billing period.
No refunds for partial months. If you cancel mid-cycle, you retain access until the period ends.
Free trials, if offered, automatically convert to paid subscriptions unless cancelled before the trial ends.

6. Third-Party Integrations

The Service integrates with third-party platforms including Square, Google, Yelp, Stripe, and others. Your use of these integrations is subject to their respective terms of service. We are not responsible for the availability, accuracy, or policies of third-party services. You may disconnect integrations at any time.

7. Data and AI-Generated Content

Reports, insights, and recommendations are generated by AI and are provided for informational purposes only.
We do not guarantee the accuracy, completeness, or suitability of AI-generated content for any particular purpose.
Financial projections and savings estimates are based on analysis of available data and may not reflect actual results.
You are responsible for verifying information before making business decisions.

8. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Attempt to gain unauthorized access to our systems
Scrape, crawl, or otherwise extract data from our platform for commercial purposes
Interfere with the proper functioning of the Service
Impersonate another person or entity
Use the Service to generate spam or fraudulent content

9. Intellectual Property

The Service, including its design, features, and content, is owned by Champion and protected by intellectual property laws. You retain ownership of your data. By using the Service, you grant us a limited license to process your data as needed to provide the Service.

10. Limitation of Liability

To the maximum extent permitted by law, Champion shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure.

12. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately, and we will delete your data in accordance with our Privacy Policy.

13. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or through the platform. Continued use after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts of San Diego County, California.

15. SMS/Mobile Messaging

By providing your phone number on our website and opting in, you consent to receive SMS messages from Champion. These messages may include:

Verification: One-time passcodes (OTP) for account security and report access.
Review Alerts: Notifications when your restaurant receives new customer reviews.
Daily Briefings: Automated daily summaries of your restaurant's performance.

Opt-Out: You can cancel the SMS service at any time. Just text "STOP" to our short code or long code. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

Help: If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at hello@iamchampion.ai.

Interruption: Carriers are not liable for delayed or undelivered messages.

Rates: As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive occasional alerts and daily briefings based on your subscription. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
